Content Policy & Advertising Guidelines
Purpose and Scope
OrkaTV’s Watch Orka is a streaming TV solution for smart TV operating systems across the U.S. including content type Free Ad-Supported Television (FAST) aggregating licensed content through carriage agreements. We aim to deliver a family-friendly, legally compliant experience to our viewers and advertisers. This policy applies to all programming and advertising on the OrkaTV platform. All content providers, distribution partners, and advertisers must adhere to these standards.
At OrkaTV we have zero tolerance for content that could damage the brand reputation and put the credibility of our advertising partners at risk. Every content provider has to mandatorily follow the content guidelines listed below to be considered eligible for monetization on our platform. The guidelines fall into two categories depending on the nature of the content.
Any programming or other content that contains prohibited content will be rejected or removed and not eligible for monetization.
Any programming or other content that contains restricted content will be allowed to monetize depending on the local jurisdiction in which the app operates.
1. Prohibited Content
Publishers, content providers and other supply partners are prohibited from using the OrkaTV platform (including our marketplaces) to monetize the following content:
- Adult sexual content, including full nudity or depictions/descriptions of sexual acts in the ad creative.
- Graphic or excessive violence including, but not limited to, physical assault, injury to human beings or animals, and all acts of terrorism.
- Harassment, bullying, threats, or content that be categorized as hate speech that advocates violence or hatred against any group, organization, or individual.
- Discrimination by race, ethnicity, nationality, religion, disability, gender, age, or sexual orientation.
- Illegal drugs or drug paraphernalia. This includes illegal drugs, recreational and herbal drugs, and accessories associated with drug use. This is a global prohibition, except for country specific exemptions. See Restricted Content below.
- Internet abuse including, but not limited to, the use of spyware, corrupted files, or other materials that are intended to damage or render inoperable software or hardware.
- Illegal internet activities including, but not limited to, pirated software and digital games, counterfeit goods, etc.
- Content that violates or infringes upon any third-party intellectual property rights or any other third-party rights.
- Weapons and weapon accessories including, but not limited to, guns, gun accessories, and explosives.
2. Restricted Content
Publishers, content providers, and other supply partners are allowed to use OrkaTV services to monetize the following restricted content, provided they strictly adhere to the country specific regulations or laws.
- Tobacco products and accessories including, but not limited to, cigarettes, cigars, e-cigarettes.
- Online and offline sale of alcoholic beverages including, but not limited to, beer, wine, and spirits.
- Illegal drugs or drug paraphernalia. This is a global prohibition, except for country specific exemptions.
- Promotion of gambling or content promoting online or offline casinos, sports betting and social casino games should strictly adhere to the regulations, as defined in the region of operation.
3. Content Standards
Prohibited Content
The following types of content are strictly prohibited on OrkaTV:
- Pornography and Sexually Explicit Material
- No explicit sexual content, nudity, or pornographic material is allowed. Contextually appropriate sexual themes consistent with a TV-14 rating may be accepted.
- Hate Speech and Harassment
- Content may not promote hatred, harassment, or violence against any person or group based on race, ethnicity, religion, gender, sexual orientation, nationality, disability, or other protected status.
- Extreme or Gratuitous Violence
- Depictions of violence must be moderate, contextual, and aligned with a TV-14 threshold. Excessive gore, torture, or glorification of violence is not permitted.
- Illegal Activities
- Content may not promote, instruct, or glorify illegal activities. Incidental or contextual references to drug use may be allowed if appropriate to a TV-14 standard and not glamorized.
- Misinformation and Harmful Content
- Content known to be false, misleading, or harmful – particularly related to health, safety, elections, or public welfare – is prohibited.
- Child Exploitation or Endangerment
- OrkaTV maintains zero tolerance for content that depicts or facilitates exploitation, harm, or inappropriate targeting of minors.
- Copyright-Infringing Content
- All content must be properly licensed. Unauthorized, pirated, or infringing content will not be accepted.
- Other Illegal or Inappropriate Content
- This includes defamatory, privacy-violating, or otherwise objectionable material as determined by OrkaTV.
- Ratings and Classification
- Content must be clearly labeled with accurate age-based ratings. OrkaTV primarily supports content within TV-G to TV-14 classifications. Content rated TV-MA or unrated material with mature content is not accepted.
Advertising Standards
OrkaTV Advertising Guidelines (“Guidelines”)
These Guidelines govern all advertising (“Ads”) placed with OrkaTV, Inc. on its Services including advertising on the user interface of the OrkaTV operating system, on any OrkaTV-branded website and/or application (including The OrkaTV Channel), and/or on any application or channel delivered through the OrkaTV operating system. OrkaTV may reject any Ads including for reasons such as violation of these Guidelines. In OrkaTV’s sole discretion, OrkaTV may establish the times during which any Ads may run or other similar parameters. These Guidelines are subject to change by OrkaTV at any time.
ADVERTISING GUIDELINES IN GENERAL
All advertising must meet the same standards set for programming content and comply with applicable U.S. and international advertising laws. In addition, the following categories are prohibited or restricted:
Ads must not contain false, misleading, fraudulent, or deceptive claims or content. You must have evidence in support of your advertising claims where this is required by applicable law or self-regulatory guidance.
Ads must be recognizable as an Ad for and clearly represent the company, product, service, or brand that is being advertised. Products and services promoted in the ad copy must be clearly represented, and the destination site may not offer or link to any prohibited product or service.
Prohibited Advertising Categories
- Adult entertainment or sexual products
- Tobacco products, vaping devices, and illicit drugs
- Firearms, ammunition, or weaponry
- Political or religious advocacy advertising
- Fraudulent, deceptive, or predatory financial products or services
- Deepfakes or misleading AI-generated representations
Restricted Categories (Subject to Prior Review and Approval)
- Alcoholic beverages- Gambling, betting services, or online casinos
- Pharmaceuticals or health supplements
- Weight loss or cosmetic enhancement products
- Financial services (loans, crypto, credit repair)
Other Requirements
- Ads may not: include hate speech; discriminate against, tolerate discrimination against, or promote discrimination against, any individual or group (including, without limitation, on grounds of race, ethnicity, religion, gender, age, disability or sexual orientation); encourage conduct that violates any applicable law or regulatory policies or guidelines; infringe upon intellectual property rights, personal rights, or proprietary rights or other legal rights under applicable law; contain nudity, depict people in sexually explicit or suggestive positions, or contain content of an inherently sexual nature that is inappropriate for a general viewing audience (or which aims to reduce a person to a sexual object); contain obscene language; promote or display excessive violence; or contain content that harms children or young people mentally or physically, or which creates fear or is instrumental in causing misfortune or suffering.
- Ads must comply with truth-in-advertising regulations, including those issued by the FTC, FCC, and other regulatory bodies.
- Sponsored content or branded entertainment must be clearly labeled.
- Advertising may not be placed adjacent to sensitive or unsuitable programming content.
- Ad creative must be suitable for a general audience and should not target minors.
- Ads must run in a language that is relevant to the language of the channel and/or its target audience and as otherwise required by applicable law.
- Ads should be :15 or :30 in duration. Exceptions may be made for :60 ads.
- Each instance of advertising, sponsorship, underwriting, presented-by credits or other third party attribution in channel application logos or banner ads must be expressly pre-approved in writing by OrkaTV.
- Ads must comply with all applicable advertising laws and regulations, including self-regulatory guidance.
- OrkaTV may establish restrictions or prohibitions in certain jurisdictions on ads for certain categories of products and services or that include certain content that may be required by applicable laws or self-regulatory guidelines.
4. Compliance, Takedowns, and Enforcement
- OrkaTV reserves the right to reject, remove, or suspend any content or advertiser at its sole discretion.
- Content providers will be notified of any policy violations and may be given an opportunity to remediate where appropriate.
- Repeated or egregious violations may result in suspension or termination from the platform.
- Valid legal requests (e.g., DMCA notices, court orders) will be promptly addressed.
- Providers have the right to appeal decisions through OrkaTV’s Content Standards Team
5. Provider Responsibilities and Indemnification
By distributing content or advertising via OrkaTV, all providers agree to:
- Ensure they have the full rights, licenses, and permissions to distribute all submitted content.
- Accurately classify and label all programming.
- Promptly respond to content inquiries, takedown notices, or compliance investigations.
- Comply with all applicable laws, including those in the United States, European Union, and other relevant jurisdictions.
- Indemnify OrkaTV against any third-party claims, damages, or liabilities arising from the content or advertisements they provide.
6. Policy Updates and Platform Rights
OrkaTV may update this policy from time to time. All updates will be published to the OrkaTV website and effective upon publication. Continued use of the platform indicates acceptance of any policy changes.
